<br />3. If, in any two consecutive quarters, average daily <br />tonnage exceeds 720, the app1icant shall apply for a <br />new use permit to expand the facility. Upon approval <br />or conditional approval of the use permit, the <br />applicant then shall apply for all applicable solid <br />waste permits, air pollution control permits and water <br />quality control permits, as prescribed by the state <br />Government Code in effect at the time. <br /> <br />4. The transfer station shall be maintained and operated <br />according to all County, state and local agency rules <br />and regulations governing such a facility. All such <br />permits shall be obtained and maintained effective <br />during the operation of this use permit. violation of <br />these regulations will be considered a violation of <br />the use permit. The City shall be notified <br />immediately should any required permit lapse or should <br />the applicant be found by such agency to be in <br />violation of any permit requirement. <br /> <br />5. All transfer station facilities shall be maintained in <br />a dust-free, odor-free and orderly manner, to the <br />greatest extent possible given the nature of the use. <br />Loose trash, unbaled or uncontained recyclables, <br />overflowing storage bins, improper storage of <br />hazardous materials shall be considered a violation of <br />the use permit performance standards. <br /> <br />6. Any proposed expansion or intensification of the <br />transfer station operations shall be submitted to the <br />planning Director for review. The planning Director <br />shall determine whether such proposed intensification <br />or expansion is within the limits of transfer station <br />activities as permitted by this use permit. Should <br />the Director determine that the expansion or <br />intensification of the use is not covered by this <br />permit, a new use permit shall be required. The <br />Director may refer the matter to the Planning <br />commission for review. Any expansion or <br />intensification of use also shall receive review and <br />approval by responsible local, State and federal <br />agencies. <br /> <br />7. The use permit for the waste transfer station shall be <br />reviewed by the Planning Director every two years to <br />ensure compliance with the conditions of approval of <br />the permit. Should the Planning Director find that <br />the conditions of approval have not been observed, or <br />that continuing non-compliance with conditions has <br />become a problem, the Director may refer review of the <br />use permit to the Planning Commission. <br />
