<br />4. No ancillary use on the site shall have a right to occupy the <br />site continuously.. Upon bi-annual review of the use permit, the <br />city shall determine whether all uses are being operated in <br />accordance with all conditions of approval and performance <br />standards. If a use has expanded beyond the limits set by the <br />use permit, the applicant shall apply for a new use permit. If <br />the applicant applies for a use permit to expand the transfer <br />station/recycling activities, the City reserves the right to <br />require termination of any and all ancillary uses on-site, if <br />necessary, to accommodate the expanded transfer station and <br />recycling facility. <br /> <br />5. The applicant and/or other tenants shall obtain all building and <br />other applicable City permits for the project prior to the <br />commencement of construction, and prior to any future <br />construction/improvement on the site. <br /> <br />6. Fire/Hazardous Materials safety <br /> <br />A. The applicant shall submit to the City's Fire Department <br />for review and approval, a Fire Prevention and Emergency <br />Plan, within ninety (90) days of approval of this use <br />permit. said Plan shall include, but not be limited to: <br />on-site fire prevention measures; locations of all fire <br />extinguishers, on-site hydrants, emergency shut-off valves, <br />flammable materials, etc.; and shall describe in full fire <br />prevention standards to which the site and all its <br />operations shall be subject, and all fire emergency <br />procedures, including employee training measures. <br /> <br />At least one copy of said Plan shall be kept on-file with <br />the city's Fire Marshall, at least one copy shall be kept <br />on-site, and at least one copy shall be filed (when <br />required) with each and any local or state agency <br />responsible for monitoring or permitting any activities on <br />site. The Plan shall be subject to annual review, and <br />shall be revised as necessary. The applicant shall provide <br />the city's Planning Department with a statement of the <br />Plan's annual review. Should the city's Fire Marshall, or <br />any responsible agency, determine that the Plan is <br />inadequate, or that on-site fire prevention measures are <br />insufficient, the applicant shall have ninety (90) days to <br />remedy the problem before the use permit is subject to <br />review by the Planning commission. <br />
