<br />8. Covenants, Conditions, and Restrictions (CC&R's) <br /> <br />a. The applicant shall record CC&R's at the time of <br />recordation of the final map which shall incorporate this <br />site in the master homeowners association of PUD-91-11 <br />and, if desired, may create a separate homeowners <br />association for responsibilities with this project. The <br />CC&R's shall be subj ect to the review and approval of the <br />city Attorney prior to recordation of the final map. <br /> <br />The homeowners association shall be responsible for the <br />maintenance of private front and side yard landscaping <br />directly facing a public street for lots 1-82, the two <br />recreation areas, public right-of-way landscaping located <br />along lots 83-88, and other common areas including all <br />landscaping and soundwalls extending to the face of curb <br />of Stoneridge Drive. The City shall be granted the <br />rights and remedies of the association, but not the <br />obligation, to enforce the maintenance responsibilities <br />of the property owners association. <br /> <br />b. Development standards as listed under Conditions 4.d. and <br />4.e. <br /> <br />c. The CC&R's shall also include building siting standards <br />for decks, patio covers, pools, and other accessory <br />structures for review and approval by the Planning <br />Director prior to approval of a final map. said <br />standards shall limit such structures in such a way as to <br />ensure adequate open space in rear/side yards while <br />allowing reasonable use of accessory structures. <br /> <br />9. The applicant shall participate in the funding of a noise <br />analysis to be completed by the city for the Stoneridge Drive <br />Specific Plan area. Payment shall be made prior to <br />recordation of the final map. The report shall identify the <br />location of the 55 dB Ldn aircraft noise contour for <br />Stoneridge Drive. The project developer shall be subject to <br />the requirements identified in the noise report as required by <br />the Planning Director to mitigate long-term noise impacts from <br />stoneridge Drive. <br /> <br />Residential uses located within the 55 dB Ldn aircraft noise <br />contour shall be designed to meet the single event interior <br />noise level of 50 dBA in bedrooms and 55 dBA in other rooms. <br />All new and resold homes shall be subject to a real estate <br />disclosure notice indicating the existence of the Livermore <br />airport, its location, flight patterns, and potential air <br />traffic increases as disclosed in the Airport Master Plan. <br />This notice shall be reviewed and approved by the city <br />Attorney prior to sale of any unit in this project. <br />
