6. The business owner/property owner or designated representative of the business shall <br /> maintain the area surrounding the restaurant/bar, outdoor areas, adjacent walkways, <br /> parking lots, and public sidewalks in front of and 100 feet therefrom the north and south <br /> limits of the structure, in a clean and orderly manner at all times. The public sidewalks <br /> and private property adjacent to the restaurant/bar shall be cleaned each morning prior to <br /> neighboring retail business hours. These areas shall be regularly monitored to ensure <br /> public peace and sanitary conditions. <br /> <br /> If non-compliant, the Planning Director may immediately suspend the conditional use <br /> permit. The Planning Commission shall hold a public hearing within 40 days, and if not <br /> satisfied that the regulation, general provision or condition is being complied with, may <br /> revoke the use permit. <br /> <br />7. The outdoor patio shall be for dining only. No alcohol shall be consumed on the patio <br /> unless patrons are seated and eating a 'bona fide' meal served by waitstaff. Otherwise, <br /> alcohol service and consumption is allowed only within the physical building envelope. <br /> The owner(s) shall ensure that no alcoholic beverages are taken outside. <br /> <br /> The doors of the restaurant/bar shall remain closed when not being used for <br /> ingress/egress purposes. The applicant shall install self-closing door mechanisms on all <br /> exterior doors. <br /> <br /> If non-compliant, the Planning Director may immediately suspend the conditional use <br /> permit. The Planning Commission shall hold a public heating within 40 days, and if not <br /> satisfied that the regulation, general provision or condition is being complied with, may <br /> revoke the use permit. <br /> <br />8. The property owner shall make a good faith effort to work with the neighboring property <br /> owner to repair the existing wooden fence located in the parking lot between 347-351 St. <br /> Mary Street and 446 St. John Street, and install a 6-foot chain link fence adjacent to it to <br /> prevent patrons from cutting through to gain access to 725 Main Street. The property <br /> owner shall a make a good faith effort to work with the neighboring property owner to <br /> maintain both fences in good repair and immediately repair any damage caused by <br /> patrons. <br /> <br />9. The business shall comply with State law, as well as Pleasanton Municipal Code about <br /> smoking in public and work places. <br /> <br /> <br />
