EXHIRIT B <br /> CONDITIONS OF APPROVAL <br /> <br /> PAP-76/UP-88-17, Union Jack Pub <br /> 725 Main Street <br /> April 5, 2005 <br /> <br /> 1. The operation of a business at 725 Main Street serving alcohol after 10:00 shall conform <br /> to the requirements of UP-88-17 unless modified by the following conditions. <br /> <br />2. The owner shall ensure that the restaurant component fully complies with the existing <br /> conditional permit approval. Meals shall be served at all times that alcohol is served. The <br /> meals prepared may be a combination of hot and cold dishes and must be a 'meal' as <br /> defined by the Alcoholic Beverage Control Act (Business and Professions Code §23038) <br /> and be served by waitstaff. Microwave dishes as sole menu item(s) will neither be <br /> construed as 'meals' nor meet the definition of restaurant service. The owner shall <br /> provide a menu for review and approval by the Planning Director. <br /> <br /> If non-compliant, the Planning Director may immediately suspend the conditional use <br /> permit. The Planning Commission shall hold a public heating within 40 days, and if not <br /> satisfied that the regulation, general provision, or condition is being complied with, may <br /> revoke the use permit. <br /> <br /> 3. The operation of the restaurant/bar shall be limited to the following hours: <br /> 11:00 am to 11:00 pm Sunday through Thursday; <br /> 11:00 am to 12:00 midnight Friday and Saturday. <br /> The restaurant/bar may remain open from 11:00 am to 1:00 am on New Year's Eve. <br /> <br /> If non-compliant, the Planning Director shall refer the conditional use permit to the <br /> Planning Commission. The Planning Commission shall hold a public hearing within 40 <br /> days, and, if not satisfied that the regulation, general provision, or condition is being <br /> complied with, may suspend or revoke the use permit. <br /> <br />4. The business owner and property owner will engage security personnel to the satisfaction <br /> of the Pleasanton Police Department and/or Planning Director. The security guard will <br /> keep weekly reports identifying the activities occurring on site and shall make available <br /> review of those reports when asked by the Police Department or any other City <br /> representative including the Planning Director or his designee. <br /> <br />5. The owner shall install signs in the interior of the building on and/or near the exit doors <br /> stating that the customers shall not loiter outside the establishment and shall be courteous <br /> and quiet when leaving the business and parking areas. <br /> <br /> <br />
