Resolution No. 05-020 <br />Page Two <br /> <br />WHEREAS, after a review of the materials presented, the City Council determined that a <br /> modified conditional use permit is appropriate for the site and is consistent with <br /> the zoning regulations for the zoning district of the property. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. Denies the appeal of Case PAP-76, thereby upholding the Planning Commission's <br /> decision to modify the conditional use permit for the property at 725 Main Street, <br /> subject to the conditions shown on "Exhibit B," attached hereto and made a part of <br /> this case by reference. <br /> <br />Section 2. The appellants shall be given notice of this action and informed that they have 90 <br /> days from the date of this resolution in which to file a court challenge. <br /> <br />Section 3. This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON APRIL 5, 2005 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Brozosky, McGovern, Sullivan and Mayor Hosterman <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> D~wn G.
