CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> RESOLUTION NO. 05-020 <br /> <br /> RESOLUTION DENYING THE APPEAL OF CASE PAP-76, THEREBY <br /> UPHOLDING THE PLANNING COMMISSION DECISION TO MODIFY THE <br /> CONDITIONAL USE PERMIT FOR THE PROPERTY AT 725 MAIN STREET, <br /> AS FILED UNDER CASE UP-88-17 <br /> <br />WHEREAS, the City of Pleasanton initiated the review and consideration of possible <br /> modification to, or revocation of, an approved conditional use permit for the <br /> property at 725 Main Street, to operate a restaurant/bar where alcohol is served <br /> after 10:00 p.m.; and <br /> <br />WHEREAS, zoning for the property is C-C (Central Commercial), Downtown Revitalization, <br /> Core Area Overlay District; and <br /> <br />WHEREAS, at its meeting of February 23, 2005, the Planning Commission, after having <br /> considered all public testimony, relevant exhibits, and recommendations of City <br /> staff concerning this matter, made the necessary findings to modify the existing <br /> conditional use permit and determined that a modified conditional use permit <br /> would be compatible with the existing uses in the area; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, Roy Moret, Dan <br /> Straface, and Emmanuel and Linda Periclakes submitted appeals to the decision of <br /> the Planning Commission; and <br /> <br />WHEREAS, at its meeting of April 5, 2005, the City Council received a report from the <br /> Director of Planning and Community Development, together with a copy of the <br /> staff report to the Planning Commission, regarding this matter; and <br /> <br />WHEREAS, the City Council held a public hearing on April 5, 2005, at which time the <br /> appellants and other members of the public presented evidence regarding this <br /> appeal; and <br /> <br /> <br />
