<br />Resolution No. PC-93-32 <br />Page 2 <br /> <br />B. That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />The use would be located in a light-industrial park <br />district improved with streets, sidewalks, and <br />landscaping. Parking on-site would be sufficient <br />because even though there are 17 allotted parking <br />spaces on the proposed site, all the spaces would <br />not be occupied as parents would mostly drop off <br />and pick up their children since they are very <br />young and cannot come by themselves. staff has <br />also added a condition of approval which requires a <br />15 minute break between lessons limiting the gym <br />cars to a maximum of 16 on-site at anyone time. <br />staff does not foresee a parking problem but a <br />condition of approval has been added whereby the <br />project could be reexamined at a public hearing if <br />a problem arises. <br /> <br />Noise would not be an issue here as the gym <br />teachers would play music for about 5 minutes each <br />hour on an average. The music has to be played at <br />a level for the children to follow the teachers' <br />directions and does not go above 61 dB. Staff has <br />not received any complaints from the tenants in the <br />building the Diablo Gym presently operates in (i.e. <br />at 1249 Quarry Lane) and does not foresee noise <br />problems occurring if the gym moves to Suite B at <br />1279 Quarry Lane. <br /> <br />The lease agreement for Diablo Gym indicates that <br />the gym will be fitted with two exits. The owner <br />of the building has confirmed that a double-door <br />exit will be installed to replace a window that <br />looks onto Valley Avenue. This solves the issue of <br />the Fire Department regulations which require that <br />in a space of 4,200 square feet with children <br />inside, two exits must be provided in order that <br />children be evacuated quickly in an emergency. <br /> <br />Should problems arise due to parking shortage or <br />excess traffic or noise, a condition is included <br />that will allow the use permit to be re-evaluated <br />by the Planning commission at a public hearing. The <br />gymnastic lessons will not be detrimental to the <br />public health, safety or welfare. No changes will <br />be made to the exterior of the structure, and no <br />part of the use will be conducted out of doors. <br />
