<br />Resolution No. PC-93-28 <br />Page 2 <br /> <br />The location of the house in which the piano <br />lessons are to be conducted is in a PUD-MDR zone, a <br />residential zone similar to the R-l zone. The <br />development, the planned community of staples Ranch <br />built by Kaufman and Broad, follows the regulations <br />of the R-1-6,500 zoning district except those <br />modified by conditions of approval for the <br />development. piano lessons are a use which <br />traditionally has been conducted within a <br />residence, particularly when such a service is <br />provided on such a small scale. The students are <br />equipped with headphones for their keyboards and, <br />therefore, their playing would not be heard aloud. <br />The windows have special panes to shield the home <br />from exterior noise and also prevent noises from <br />within reaching outside. with adequate parking on <br />the street, parking problems would be eliminated. <br />As proposed, the use would not generate excessive <br />traffic, parking demand, or noise. Therefore, the <br />lessons would be conducted in accordance with <br />Chapter 18.104, and so would meet the objectives of <br />the zoning ordinance. <br /> <br />B. That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />The use would be located in a single-family home. <br />The area is improved completely with streets and <br />sidewalks, which is advantageous for students who <br />would walk or ride bicycles to lessons. These <br />improvements provide a measure of safety for the <br />students, and create low potential for interference <br />with other vehicles on the streets. <br /> <br />3683 Annis Circle is occupied by only two resi- <br />dents, the applicant and her spouse. The cars they <br />own are always parked in their two-car garage. <br />This frees the driveway and six parking spaces on <br />the two streets in front of the house (all six <br />spaces are in front of the house and not on the <br />opposite side of W Las positas Boulevard or Annis <br />Circle). with a maximum of four students at any <br />one time, parking is not a foreseeable problem even <br />if all four students are above age 16 and come in <br />individual cars. Should problems arise due to <br />parking shortage or excess traffic, a condition <br />will allow the use permit to be re-evaluated by the <br />Planning Commission at a public hearing. <br />
