Resolution No. PC-93-28
Page 2

The location of the house in which the piano
lessons are to be conducted is in a PUD-MDR zone, a
residential zone similar to the R-l zone. The
development, the planned community of staples Ranch
built by Kaufman and Broad, follows the regulations
of the R-1-6,500 zoning district except those
modified by conditions of approval for the
development. piano lessons are a use which
traditionally has been conducted within a
residence, particularly when such a service is
provided on such a small scale. The students are
equipped with headphones for their keyboards and,
therefore, their playing would not be heard aloud.
The windows have special panes to shield the home
from exterior noise and also prevent noises from
within reaching outside. with adequate parking on
the street, parking problems would be eliminated.
As proposed, the use would not generate excessive
traffic, parking demand, or noise. Therefore, the
lessons would be conducted in accordance with
Chapter 18.104, and so would meet the objectives of
the zoning ordinance.

B. That the proposed location of the conditional use
and the conditions under which it would be operated
or maintained will not be detrimental to the public
health, safety, or welfare, or materially injurious
to the properties or improvements in the vicinity.

The use would be located in a single-family home.
The area is improved completely with streets and
sidewalks, which is advantageous for students who
would walk or ride bicycles to lessons. These
improvements provide a measure of safety for the
students, and create low potential for interference
with other vehicles on the streets.

3683 Annis Circle is occupied by only two resi-
dents, the applicant and her spouse. The cars they
own are always parked in their two-car garage.
This frees the driveway and six parking spaces on
the two streets in front of the house (all six
spaces are in front of the house and not on the
opposite side of W Las positas Boulevard or Annis
Circle). with a maximum of four students at any
one time, parking is not a foreseeable problem even
if all four students are above age 16 and come in
individual cars. Should problems arise due to
parking shortage or excess traffic, a condition
will allow the use permit to be re-evaluated by the
Planning Commission at a public hearing.
