"

PLANNXNG COMMXSSXON CXTY OF PLEASANTON

ALAMEDA COUNTY, CALXFORNXA

RESOLUTION NO. PC-93-28

RESOLUTXON APPROVXNG A NON-EXEMPT HOME OCCUPATXON CONDXTXONAL
USE PERMIT AS FILED UNDER CASE UP-93-22, THE APPLICATXON OF
KATHLEEN L. DEFXLLO

WHEREAS, Kathleen L. Defillo has applied for a non-exempt home
occupation conditional use permit to conduct piano
lessons within a single-family residence located at 3683
Annis circle; and

WHEREAS, zoning for the property is Planned Unit Development (PUO)
- Medium Density Residential District; and

WHEREAS, at their duly noticed public hearing of May 26, 1993, the
Planning Commission considered all public testimony,
relevant exhibits and recommendations of the city staff
concerning this application; and

WHEREAS, the Planning commission made the following findings:

A. That the proposed location of the conditional use
is in accordance with the objectives of the zoning
ordinance and the purpose of the district in which
the site is located.

Chapters 18.32 and 18.36 permit home occupations to
be conducted in residences in the R-1 and RM zones,
in accordance with Chapter 18.104 (Home
Occupations). Some of the objectives of the R-1
and RM districts are to protect residential
properties from the hazards, noise and congestion
created by commercial and industrial traffic, and
to protect properties from noise, illumination,
unsightliness, odors, dust, and other objectionable
influences.

The objective of Chapter 18.104 is to permit
certain home occupations which will not adversely
affect the residential character of the
neighborhood, yet permit the operation of certain
activities which normally occur in residences, such
as piano lessons. The required conditions for non-
exempt home occupations meet the objectives of the
R-1 and RM zones by not permitting manufacturing or
deliveries to the home or the creation of
pedestrian or vehicular traffic in excess of that
usually generated by residential uses.
