<br />8. single-story units shall be located on Lot Nos. 39/40 and two- <br />story units shall be located on Lot Nos. 35/36. The change <br />shall be shown to the satisfaction of the planning Director on <br />the lotting plan to be provided at the tentative map stage. <br /> <br />9. Final fence, landscape, and irrigation plans and design <br />details shall be reviewed and approved by the Design Review <br />Board prior to issuance of a building permit and shall <br />incorporate the following requirements: <br /> <br />a) The masonry soundwall along Lot Nos. 1-4 shall match the <br />soundwall design used on the Far West development; <br /> <br />b) Fences on the streets ide of a corner street side shall be <br />setback 15' from the closest front corner of the unit; <br /> <br />c) The dwarf heavenly bamboo and heavenly bamboo shrubs <br />shall be 5 gallon size, and the oleander shrub shall be <br />deleted from the plant list; <br /> <br />d) Shrubs to be planted in groupings, hedges, screens, etc., <br />shall be spaced so that at lOOt maturity they overlap <br />each other by 25%; and <br /> <br />e) One tree shall be installed in the planting area between <br />the driveway aprons in addition to the trees already <br />shown on the landscape plan. <br /> <br />10. The project developer shall install all front and side yard <br />landscaping and irrigation on all lots as shown on the final <br />landscape plan within 30 days of close of escrow. <br /> <br />1l. The developer shall install the soundwall along Lots 1-4 with <br />the first phase of construction. <br /> <br />l2. The applicant shall record CC&R's (Covenants, conditions, and <br />Restrictions) at the time of recordation of the final map <br />which shall create a homeowners association for the <br />development. The CC&R's shall be subject to the review and <br />approval of the city Attorney prior to recordation of the <br />final map. The homeowners association shall be responsible <br />for the following: <br /> <br />a) Maintenance of all private front and side yard <br />landscaping directly facing a public street; <br /> <br />b) The temporary drainage ditch to be located along the <br />south and west project property lines. <br /> <br />The city of Pleasanton shall be granted the association's <br />rights and remedies, but not the obligation, to enforce the <br />maintenance responsibilities of the homeowners association. <br /> <br />. <br />
