<br />the hillside should remain as open space in perpetuity, in accordance with the City's general Plan <br />land use designation of the site. Additionally, proper maintenan= of the hillside open space <br />must occur to prevent potential hazards of landslides, soil creep, wildland fires, etc. due to <br />negligence or lack of a maintenance program for the open space area. <br /> <br />DEGREE: Potentially Significant. <br /> <br />FINDING: The Commission finds that property-owners' granting of a conservation easement <br />over the 44 acres of hillside open space, in favor of the City, will be effective in assuring <br />retainment of the open space area (Condition 9, modification of MM 3b [part 1]). The <br />Commission finds that requiring a homeowners' association to provide for landslide/soils <br />maintenance, fue management of hillside open space, etco (Condition 8, modification of MM <br />3b [part 1]) with the developer required to prepare the open space management program (MM <br />3f) are feasible and have been incorporated into the project design or into the project by <br />reference through conditions of approval, and will be effective in reducing the impacts of this <br />project to a less than significant level. <br /> <br />3. No public. on-site amenities wIthe nrooosed above ave~e density <br /> <br />IMPACT: The Commission finds that the lack of public, on-site amenities with the proposed <br />above average density is a potentially significant impact as the project does not conform fo <br />General Plan policies. <br /> <br />DEGREE: Potentially Significant. <br /> <br />FINDING: The Commission finds that implementation of a 54-unit development plan (near- <br />average density) will be effective in reducing this impact to a less than significant level, due to <br />the proximity of the EBRPD Ridglands Regional Park and the City's Augustine Bernal Park <br />which provide susfficient open space amenities for future residents. The City's General Plan <br />does not require that a project constructed at average density provide public, on-site open space <br />amenities. The Commission finds that such a measure is feasible, and has been incorporated into <br />the project design or into the project by reference through conditions of approval, and will be <br />effective in reducing the impacts of this project to a less than significant level. <br /> <br />4. Non-conformance wlWest Foothill Road Corridor Over~ District <br /> <br />IMPACT: The Commission finds that although lack of conformity with the WFRCOD <br />ordinance standards would not create an adverse environmental impact regarding land use, per <br />se, but since the City adopted these standards to protect the character of Foothill Road and <br />ensure that the impacts of residential development are minimized, the Commission does fmd that <br />lack of conformance with the WFRCOD may have an adverse effect on the environment. <br /> <br />DEGREE: Potentially Significant. <br /> <br />-2- <br /> <br />II <br /> <br />. <br />
