<br />EXHIBIT C <br /> <br />CEQAFINDINGS <br />FOR PUD-89-17l0AK TREE FARM <br />RESOLUTION NO. PC-92-1S <br /> <br />The Draft Supplemental Environmental Impact Report (Draft SEIR) has identified a number of <br />significant or potentially significant environmental impacts of the proposed 69-lot development <br />plan for the 91 acre site located at 8015 Foothill Road. The Planning Commission, as a <br />decision-making body, must make written findings explaining how it has addressed each <br />significant environmental impact and each alternative identified in the Final Supplemental <br />Environmental Impact Report (Final SEIR). The Final SEIR consists of the Draft SEIR, <br />response to comments and any changes in the Draft. If the Planning Commission adopts a <br />mitigation measure different from one recommended in the SEIR, the Commission must find that <br />the adopted measure will effect the same reduction in impact as the recommended measure. <br /> <br />Land Use and Planning Impacts <br /> <br />10 Proiect exceeds avera~e density and holdin2 caoacity <br /> <br />IMPACT: The Planning Commission finds that exceeding the average density of the site's <br />General Plan land use designations and exceeding the holding capacity of the site as defined in <br />the City's General Plan, is a significant impacto <br /> <br />DEGREE: Potentially Significant. <br /> <br />fINDING: The Commission finds that the proximity of the site to the East Bay Regional Park <br />District's Ridgelands Regional Park and the City's Augustine Bernal Park is sufficient in that <br />these parks provide open space adequate to off-set the implementation of a plan which results <br />in 54 units, such as the plan as outlined in condition 7, which will achieve near average density <br />on the site and that these measures are feasible and have been incorporated into the project <br />design or into the project by reference through conditions of approval, and will be effective in <br />reducing the impacts of this project to a less than significant level. <br /> <br />2. Unassured retainment and maintenance of (hillsid~ o,pen ~ace <br /> <br />IMP ACT: The Planning Commission finds that unassured retainment of the hillside open <br />space is a potentially significant impact, as the hillside area has been used in calculating <br />development density for the project area and the Commission feels that the open space areas on <br /> <br />-1- <br /> <br />II <br /> <br />. <br />
