That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />The proposal would provide adequate parking and <br />vehicular circulation to accommodate the proposed <br />use. Additionally, the bank plans to construct the <br />required parking space and handicap ramp <br />requirements necessary to meet the recently-adopted <br />American Disabilities Act standards. <br /> <br />The operators of the bank would install lighting at <br />the ATM cash machine to meet the state-mandated <br />requirements which would ensure the safety and <br />visibility of ATM users by patrol officers on the <br />adjacent public rights-of-way. <br /> <br />C. That the proposed conditional use will comply with <br />each of the applicable provisions of this chapter. <br /> <br />The use permit process allows for the analysis of <br />site specific proposals, the identification of <br />deviations from the zoning ordinance, and the <br />establishment of appropriate mitigation through <br />conditions of approval. The bank will be in <br />compliance with relevant code requirements except <br />for signage, which is addressed as a condition of <br />approval. <br /> <br />For properties located in the civic Overlay District, the <br />following additional findings must be made by the <br />Planning commission prior to the granting of a use <br />permit: <br /> <br />D. That the proposed location, development plan, and <br />architectural treatment comply with the standards <br />contained in the civic Overlay District. <br /> <br />The proposed project would involve minor changes to <br />the exterior of an existing free-standing building <br />and parking lot area. These changes would involve <br />the demolition of an existing automobile drive-thru <br />structure, the addition of new parking spaces, and <br />the addition of a walk-up ATM machine. These <br />changes would result in the addition of landscaping <br />to the site which currently meets the minimum area <br />(10% of the lot, excluding parking, walkways, and <br />landscaped areas).
