.'

Resolution No. PC-95-75
Page 2

B. The proposed location of the conditional use and
the conditions under which it would be operated or
maintained will not be detrimental to the public
health, safety, or welfare, or materially injurious
to the properties or improvements in the vicinity.

If operated in accordance with the applicant's plan
and the recommended conditions of approval, the
tutoring lessons will not be detrimental to the
public, health, safety, or welfare. Although
additional vehicular traffic will be created by the
applicant's clients, the number of class sessions
would be limited to three per day and nine per
week, so that the number of vehicular trips to the
residence will not be excessive to the neighborhood
as a whole. Should issues related to traffic or
parking arise as part of the home occupation, the
use permit can be reviewed and further conditions
may be imposed to resolve the issues. No changes
would be made to the exterior of the home and no
part of the use would be conducted out of doors.

C. The proposed conditional use will comply with each
of the applicable provisions of this chapter.

The home occupation is required to comply with the
conditions of this use permit and those stipulated
in Chapter 18.104.30. conditions for the operation
of the home occupation which further ensure
compliance with the zoning ordinance and its
objectives have been included. As with any use
permit, the home occupation permit can be suspended
or revoked if the conditions are not met.

WHEREAS, projects of this nature are categorically exempt from the
requirements of the California Environmental Quality Act
(CEQA); and

WHEREAS, the Planning Commission determined that the proposed home
occupation use, as conditioned, would not have any
adverse impact on the character of the neighborhood, nor
would it create an excessive amount of noise or traffic.
