The proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />If operated in accordance with the applicant's plan <br />and the recommended conditions of approval, the <br />tutoring lessons will not be detrimental to the <br />public, health, safety, or welfare. Although <br />additional vehicular traffic will be created by the <br />applicant's clients, the number of class sessions <br />would be limited to three per day and nine per <br />week, so that the number of vehicular trips to the <br />residence will not be excessive to the neighborhood <br />as a whole. Should issues related to traffic or <br />parking arise as part of the home occupation, the <br />use permit can be reviewed and further conditions <br />may be imposed to resolve the issues. No changes <br />would be made to the exterior of the home and no <br />part of the use would be conducted out of doors. <br /> <br />C. The proposed conditional use will comply with each <br />of the applicable provisions of this chapter. <br /> <br />The home occupation is required to comply with the <br />conditions of this use permit and those stipulated <br />in Chapter 18.104.30. conditions for the operation <br />of the home occupation which further ensure <br />compliance with the zoning ordinance and its <br />objectives have been included. As with any use <br />permit, the home occupation permit can be suspended <br />or revoked if the conditions are not met. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the proposed home <br />occupation use, as conditioned, would not have any <br />adverse impact on the character of the neighborhood, nor <br />would it create an excessive amount of noise or traffic. <br />
