<br />EXHIBIT "B" <br />PUD-95-03 <br />PLANNING COMMISSION <br />CONDITIONS OF APPROVAL <br /> <br />PLANNING <br /> <br />I. Development shall be substantially as shown on the Design Guidelines/Development <br />Standards, Exhibit "A", dated "Received August 2, 1995", and the Development Plans, <br />Exhibit "A", dated "Received September 22, 1995" on file with the Planning Department, <br />except as modified by the following conditions Minor changes to the plans may be <br />allowed subject to the approval of the Planning Director if found to be in substantial <br />conformance to the approved exhibits. <br /> <br />2. The subject development is zoned PUD-MDR and shall be governed by all permitted and <br />conditional uses of the R-l-l 0,000 Zoning District All development standards shall be <br />based on the R-I-IO,OOO zoning district except as modified by the PUD Design <br />GuidelineslDevelopment Standards herein incorporated by reference <br /> <br />3. Specific details of the private, shared access easement/driveway serving Ernest Jones's <br />property and the subject development shall be submitted as part of any tentative map <br />application for review and approval <br /> <br />4. Access to Ernest Jones's property shall be maintained at all times during construction <br /> <br />5. A deed restriction, or similar instrument approved by the City Attorney, shall be recorded <br />on Lot #9 that specifies that all future property owners of Lot #9 shall agree to remove the <br />driveway pavement or allow a future developer to remove said pavement should the <br />Ernest Jones's easement over Lot #9 be abandoned in the future The future property <br />owner may apply to the City for Administrative Design Review to keep the pavement <br />Any such design review shall include a list of uses and structures which will be installed in <br />this area, and the City through the design review process may attach conditions to regulate <br />possible adverse impacts to the surrounding neighbors <br /> <br />6. Within thirty (30) days after construction of the public street, the developer shall <br />reimburse Mr. Jones for any expense, up to a maximum of$I,OOO, incurred in his <br />changing his street address <br /> <br />7. The developer shall negotiate in good faith with Mr. Jones to reconflgure Mr. Jones's <br />existing driveway which is located on the northwest corner of Lot # 13.
