The proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />Each lot in the Walnut Glen Estates subdivision <br />provides a three-car garage and three open on-site <br />parking spaces located on the back-out apron in <br />front of the garage, for a total of six parking <br />spaces. A condition of approval requires that one <br />of these spaces be continuously available for the <br />secondary dwelling unit. Thus, the City's standard <br />parking requirement for secondary dwelling units <br />would be fulfilled. <br /> <br />The secondary dwelling unit is integrated into the <br />design and construction of the proposed building <br />model plans. Generous side and rear building <br />setbacks are provided with each of the building/lot <br />combinations of this development. Except for one <br />secondary dwelling unit, none of the proposed <br />secondary dwelling units would have a second floor <br />balcony overlooking adjoining yards. Even with <br />this plan, however, the secondary dwelling unit's <br />balcony would face the garage/back-out apron on the <br />opposite lot, not a potentially sensitive private <br />rear yard. <br /> <br />If a secondary dwelling unit is proposed to be <br />constructed in conformance to this approval after <br />occupancy of the primary residence, when homes on <br />adjoining lots are also occupied, the applicant is <br />required to initiate an administrative review <br />procedure requiring written notice of the proposal <br />to all adjoining property owners. This procedure <br />would identify concerns and provide the means to <br />achieve their resolution. <br /> <br />The homeowner may use the optional floor area as <br />part of the primary residence, e. g., media room, <br />guest room, etc., or as a secondary dwelling units. <br />The overall occupancy and, therefore, trip <br />generation of the primary residence with/without <br />the secondary dwelling unit would be similar. Even <br />if the secondary dwelling unit is rented, any <br />additional trips from the secondary dwelling unit <br />would be minimal. <br />
