CONDITIONAL USE PERMIT FINDINGS <br /> <br />The Planning Commission needs to make use permit findings prior to approving a modi- <br />fication of the conditional use permit. These findings must relate to the specific modifi- <br />cations being made. The Planning Commission may decide to adopt a variety of modifi- <br />cations to address issues of non-compliance with the conditions of approval. The Plan- <br />ning Commission needs to be able to make the following findings based on the modifica- <br />tions that it approves: <br /> <br />1. As modified, the location of the proposed conditional use is in accordance with the <br /> objectives of the zoning ordinance and the purpose of the district in which the site <br /> is located. <br /> <br /> The subject site is located in the Central Commercial (C-C) zoning, Downtown <br /> Revitalization and Core Overlay Districts. One of the purposes of the C districts is <br /> to provide opportunities for, and concentration of, service and amusement estab- <br /> lishments that have mutually beneficial relationships with each other for the con- <br /> venience and enjoyment of the public. Although the pub caused problems in the <br /> Downtown area, with added and amended conditions, the use should once again be <br /> appropriate in this location. <br /> <br />2. As modified, the proposed location of the conditional use and the conditions under <br /> which the conditional uses would be operated or maintained will not be detrimen- <br /> tal to the public health, safety, or welfare, or materially injurious to the properties <br /> or improvements in the vicinity. <br /> <br /> With amended and added conditions, the restaurant would not have an adverse ef- <br /> fect on any surrounding properties. This is subject to the ownership complying <br /> with the conditions and monitoring to ensure that the conditions are being imple- <br /> mented. <br /> <br />3. As modified, the proposed conditional use will comply with each of the applicable <br /> provisions of Chapter 18.124 of the Pleasanton Municipal Code. <br /> <br /> The proposed reconditioned use permit will comply with all applicable sections of <br /> Chapter 18.124 of the Pleasanton Municipal Code. <br /> <br />ENVIRONMENTAL ASSESSMENT <br /> <br />This project is categorically exempt from environmental review pursuant to the Califor- <br />nia Environmental Quality Act (CEQA) as a modification to an existing use permit. On <br />the basis of an Initial Study of the potential environmental impacts of the initial project, <br />the Director of Planning and Community Development determined that the proposed <br />change would have an insignificant adverse effect on the environment.
