The Planning Commission shall hold a public hearing within 40 days, <br /> and if not satisfted that the regulation, general provision or condition is being <br /> complied with, may revoke the use permit. <br /> <br /> 3. The outdoor patio shall be for dining only. Otherwise, alcohol service and con- <br /> sumption is allowed only within the physical building envelope. The owner(s) <br /> shall ensure that no alcoholic beverages are taken outside. <br /> <br /> If non-compliant, the Planning Director may immediately suspend the conditional <br /> use permit. Staff suggests the addition of the fol- <br />lowing condition: <br /> <br /> 4. The owner shall repair the existing adjacent wooden fence and install a 6 foot <br /> chain link fence adjacent to it to prevent patrons from cutting through to gain ac- <br /> cess to the Union Jack Pub. The owner shall maintain both fences in good repair. <br /> Any damage by patrons shall be repaired immediately. <br /> <br />With regard to smoking: <br /> <br /> 5. The business shall comply with Chapter 9.24 of the Pleasanton Municipal Code <br /> (Smoking in Public and Work Places). <br /> <br />The use of the site is discretionary and must comply with the permit's conditions of ap- <br />proval as well as comply with the conditions imposed by the ABC. <br /> <br /> 9. The owner shall comply with all regulations associated with the license issued by <br /> ABC. If non-compliant, the Planning Director may immediately suspend the con- <br /> ditional use permit. The Planning Commission shall hold a public hearing within <br /> 40 days, and if not satisfied that the regulation, general provision or condition is <br /> being complied with, may revoke the use permit. <br /> <br />PUBLIC NOTICE <br /> <br />Staff sent notices of the Planning Commission's public hearing on this item to all prop- <br />erty owners and business tenants located within 1,000-feet of the Union Jack Pub.
