CONCLUSION <br /> <br />Staff believes that the Union Jack Pub, as currently operated, is not in compliance with <br />either the conditions of approval of its use permit or the conditions o£ its ABC license. <br />Staff suggests a series of additional conditions to ensure that the pub is a good neighbor <br />and meets City requirements. <br /> <br />STAFF RECOMMENDATION <br /> <br />The Planning Commission has four alternative actions that may be considered: <br /> <br /> · Modify the existing use permit per staff's proposed conditions; <br /> <br /> · Modify the use permit per amended staff conditions; <br /> <br /> · Suspend the use permit; or <br /> <br /> · Revoke the use permit. <br /> <br />Staff recommends the Planning Commission: <br /> <br />1. Discuss the issues raised in this staff report, hear all public testimony, and make its <br /> determination pertaining to nuisance abatement, non-compliance with the condi- <br /> tions of approval, and any other issues raised in public testimony; <br /> <br />2. Make the required use permit findings pertaining to specific modifications to the <br /> use permit; and, <br /> <br />3. Adopt a resolution modifying the conditional use permit UP-88-17, subject to the <br /> Exhibit A, Draft Conditions of Approval, and adding any specific conditions of <br /> approval to Exhibit A; or <br /> <br />4.
