within 40 days, and, if not satisfied that the regulation, general provision, or con- <br /> dition is being complied with, may suspend or revoke the use permit. <br /> <br />The management does not appear to be able to control the activities of its patrons per the <br />requirements of the existing conditions, specifically, condition number 3 of the approval. <br />Stafftherefore suggests that a security guard be required on site. <br /> <br /> 3. The business owner and property owner will engage security personnel to the sat- <br /> isfaction of the Pleasanton Police Department and/or Planning Director. The se- <br /> curity guard will keep weekly reports identifying the activities occurring on site <br /> and shall make available review of those reports when asked by the Police De- <br /> partment or any other City representative including the Planning Director or his <br /> designee. <br /> <br /> 4. The owner shall install signs in the interior of the building on and/or near the exit <br /> doors stating that the customers shall not loiter outside the establishment and <br /> shall be courteous and quiet when leaving the business and parMng areas. <br /> <br />Adjacent private property appears to be significantly impacted by the nuisance behavior <br />of the pub's patrons. Staff suggests the addition of the following condition: <br /> <br /> 1. The business owner/property owner or designated representative of the business <br /> shall maintain the area surrounding the restaurant/bar, outdoor areas, adjacent <br /> walkways, parking lots, and public sidewalks in front of and lOO feet therefrom the <br /> north and south limits of the structure, in a clean and orderly manner at all times. <br /> The public sidewalks and private property adjacent to the restaurant/bar shall be <br /> cleaned each morning prior to neighboring retail business hours. These areas <br /> shall be regularly monitored to ensure public peace and sanitary conditions. <br /> <br /> If non-compliant, the Planning Director may immediately suspend the conditional <br /> use permit. The Planning Commission shall hoM a public hearing within 40 days, <br /> and if not satisfied that the regulation, general provision or condition is being <br /> complied with, may revoke the use permit. <br /> <br />Patrons of the Union Jack Pub consume alcohol in outside areas behind the establish- <br />ment, both on the pub's outdoor patio and on surrounding private properties. Staff sug- <br />gests the addition of the following condition: <br /> <br /> 2. The outdoor patio shall be for dining only. No alcohol shall be consumed on the <br /> patio unless patrons are seated and eating a 'bona fide' meal served by waitstaff. <br /> Otherwise, alcohol service and consumption is allowed only within the physical <br /> building envelope. The owner(s) shall ensure that no alcoholic beverages are <br /> taken outside. <br /> <br /> The doors of the restaurant/bar shall remain closed when not being used for in- <br /> gress~egress purposes.
