If such is determined, the condition requires signs stating the <br />enforcement of Section 21107.8 of the C alifomia Vehicle Code (CVC) be posted at all <br />entrances to the pub and all parking lots which have access to the pub. Failure to post said <br />signs renders the use permit null and void. Currently, no such signs are posted. <br /> <br />Opportunities to Amend Conditions: <br /> <br />In order to address and rectify the apparent non-compliance of the Union Jack Pub with <br />the conditions of approval of its use permit, staff proposes additional and amended condi- <br />tions for UP-88-17 for review and consideration by the Planning Commission in addition <br />to the existing conditions. The Planning Commission may also ammend staff's recom- <br />mendations. <br /> <br />The use permit approved the hours of operation for a restaurant/bar with the kitchen op- <br />erating from 6 am to 9 pm. The bar is currently approved to remain open until 2 am. Cur- <br />rent hours of operation are from 12:00 pm (noon) to 2 am. <br /> <br />Staff suggests a modification of the conditions to require food service with a full menu to <br />be provided by the business owner serving at a minimum lunch and dinner. <br /> <br /> 1. The owner shall ensure that the restaurant component fully complies with the ex- <br /> isting conditional permit approval. The kitchen shall operate as full service pro- <br /> viding lunch and dinner between the hours of ll a.m. to 9p.m. The meals pre- <br /> pared may be a combination of hot and coM dishes and must be a 'meal' as de- <br /> fined by the Alcoholic Beverage Control Act (Business and Professions Code <br /> 3~23038) and be served by waitstaff Microwave dishes as sole menu item(s) will <br /> neither be construed as 'meals' nor meet the definition of restaurant service. The <br /> owner shall provide a menu for review and approval by the Planning Director. <br /> <br /> If non-compliant, the Planning Director may immediately suspend the conditional <br /> use permit. The Planning Commission shall hoM a public hearing within 40 days, <br /> and if not satisfied that the regulation, general provision, or condition is being <br /> complied with, may revoke the use permit. <br /> <br /> The excessive public nuisance, public drunkenness and other undesirable behavior can be <br /> attributed to the extended hours of alcohol service to 2 am. Staff suggests a reduction of <br /> the hours as follows: <br /> <br /> 2. The operation of the restaurant/bar shall be limited to the following hours: <br /> a. 11:00 am to l l :OO pm Sunday through Thursday; <br /> b. 11:00 am to 12:00 midnight Friday and Saturday. <br /> <br /> The restaurant/bar may remain open from 11:00 am to 1:00 am on New Year's <br /> Eve. <br /> <br /> If non-compliant, the Planning Director shall refer the conditional use permit to <br /> the Planning Commission.
