Before the PUD could be approved, findings were made to prove <br />that recommended mitigation measures should be adopted to help reduce the <br />effects of those impacts. The EIR, the impacts determined to be significant, and <br />those findings do have significance for your proposal for several reasons: <br /> <br />A. Building envelopes for the steeper, hillside lots were adopted for this PUD <br />through the EIR and development review process to minimize the impacts <br />of residential development. Criteria such as topography (steepness), <br />amount of grading, geologic sensitivity, riparian characteristics, vegetation, <br />and visibility from other parts of Pleasanton were instrumental in the <br />original determination to allow development within certain areas of the <br />property, and instrumental in establishing the building envelope for each <br />lot. <br /> <br />B. Building envelopes were positioned to prevent development in areas with <br />steeply sloped topography, with potentially unstable soils, with riparian <br />habitat, and in areas which could create steep grade differences between <br />the adjacent street and a potential building pad (a public safety concern). <br /> <br />C. The proposed construction outside of an approved building envelope was <br />not considered in the environmental review process, or during the public <br />hearings for the PUD or tentative map. Building envelopes were chosen <br />specifically to restrict development in areas which had been deemed <br />sensitive during the environmental and development review process. <br /> <br />In order to consider your application to permit construction outside of the <br />approved building envelope for your lot, you application must address all of the <br />environmental concerns which were considered during the original environmental <br />and development review process and presented for review during public hearings <br />for the PUD and tentative map. The designation of building envelopes occurred <br />as part of discretionary actions on the EIR, PUD and tentative map. You have <br />requested the postponement of environmental and technical review until issuance <br />of a building pennit. However, these issues cannot be addressed at some later <br />time, such as at the building permit stage (a ministerial act with no public input), <br />because they are issues which were considered within the public forum and which <br />must be re-considered within a public forum. <br /> <br />The types of information and studies which are needed for PUD major <br />modification are as follows: <br />
