Your property is governed by a Planned Unit <br />Development (PUD), a zoning designation adopted through a City Council <br />ordinance (Ordinance 1050) with rules and regulations specific to properties <br />covered by that ordinance, as well as by any Municipal Code regulations <br />referenced within that PUD ordinance. It is the PUD regulations and PUD <br />development plan referenced in the PUD ordinance from which you must request <br />relief, since it is these documents which specify the location of the one building <br />envelope for your lot and the regulations under which your lot and all lots within <br />the PUD may be developed. Therefore, the application which you must make is <br />for a "Planned Unit Development Major Modification", not a variance. The fee <br />for such an application is ($2,000). <br /> <br />Variances are applicable for "straight-zoned" properties, i.e. those which are <br />governed exclusively by the Pleasanton Municipal Code and !l21 by development <br />standards which are unique to a particular PUD. A property-owner may request <br />relief from those regulations listed in the Municipal Code by applying for a <br />variance. Variances can be granted ~ for deviations from the allowed site <br />development standards (such as setbacks, fence heights, etc.), and only when the <br />City finds that there are unusual circumstances which would make it particularly <br />difficult or impossible for a property-owner to comply with those regulations, and <br />that such circumstances would deny the property-owner privileges enjoyed by <br />others in similar situations. [NOTE: When PUDs reference the development <br />standards listed in the Municipal Code, the variance procedure can be used only if <br />relief from one of thQ&.standards is requested. For example, if a PUD references <br />the side yard setbacks of the R-I-20 zoning district, an individual may apply for a <br />variance for relief from that development standard listed in the Municipal Code.] <br />
