Resolution No. PC-95-03
Page 5

7. If additional activities beyond that approved by the Planning
commission are desired, prior City review and approval is
required. Such modifications shall be submitted to the
Planning Director, who shall refer the matter to the Planning
commission if jUdged to be substantial.

8. If, at any time in the future, it is determined by the
Planning Director that noise, emissions, drainage, litter,
storage, parking, traffic, or other issues associated with the
proposed use are having adverse effects on surrounding uses or
the city in general, this matter can be submitted, at the
discretion on the Planning Director, to the Planning
commission for their subsequent review at a public hearing.
If necessary, the Commission may modify or add conditions of
approval to mitigate such impacts, or may revoke said use
permit.

9. The hours of operation shall be limited to 6:00am to 6:00pm,
Monday through Saturday.

10. When deemed necessary by the city Engineer, the property owner
shall dedicate an eight foot wide public service easement
along the entire Old Santa Rita Road frontage of this parcel.

11. The applicant shall enter into a deferred street frontage
improvement agreement that ensures that the property owner
shall construct or finance the construction of street
improvements along the entire Old Santa Rita Road frontage of
the site. said improvements may include, but are not
necessarily limited to grading, sidewalk, street trees, street
monuments, underground utilities, and tree removal.

12. All trash and refuse shall be contained completely within
trash enclosure(s) screened from off-site views. The location
and design of the enclosure(s) shall be designed to meet the
requirements of the Urban Clean Water Runoff Program and shall
be subject to the approval of the Planning Director. The
trash enclosure(s) shall be covered and no other area may
drain into the trash enclosure area. Trash containers shall
be stored within the enclosure(s) at all times, except when
being unloaded.

13. If signing for the site is desired, a comprehensive signing
program shall be submitted to the Planning Director for
consideration under separate application.

.
