<br />Commissioner Hovingh asked if the permit could be conditioned to suspend all massage <br />therapy until receipt of police approval. Mr. Iserson stated the Commission could add that <br />condition. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Jeanne Monsen, 3730 Hopyard Rd., represented her application for a conditional use permit. <br />She advised that she has received approval from the police department. Mr. Beougher <br />advised that her previous police approval would carry over from one business location to <br />another. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Hovingh stated his preference to not combine therapy work within a beauty <br />salon. Ms. Monsen stated that the business is not a "beauty salon" as such because they do <br />neither hair sty ling nor nails. <br /> <br />In response to Commissioner Dove, Mr. Iserson stated that the building owners do not have <br />any legal responsibility to advise their tenants of the City's permit regulations. <br /> <br />Commissioner McGuirk commented that he feels this business does not fit within the barber <br />shop/beauty salon category. Mr. Beougher stated that this is a conditional use permit <br />application within that category, not a permitted use. Mr. Iserson stated staff considers this <br />category to encompass "personal care" services. <br /> <br />Commissioner Dove motioned, seconded by Commissioner McGuirk, making the <br />conditional use permit findings and approving Case UP-95-67, subject to the conditions <br />of approval listed in Exhibit B. <br /> <br />ROLL CALL VOTE <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Barker, Dove, McGuirk, and Chairman Lutz <br />Commissioners Hovingh <br />Commissioner Wright <br />None <br /> <br />Resolution No. PC 95-91 was entered approving Case UP-95-67, as motioned. <br /> <br />b.
