She <br />would like some guarantee that future property owners/property managers will also comply <br />with the agreed-upon negotiations. <br /> <br />In response to Commissioner Dove, Ms. Hunt agreed that there may be as much noise with <br />walking the children into the facility as would occur with driving into the parking lot. <br /> <br />Commissioner Barker inquired whether the 6:30 a.m. gate opening was an arbitrary hour and <br />could there be some flexibility with the neighbors. She also noted that there were safety <br />concerns for children walking through the closed parking lot as well as fire safety issues <br />because fire/emergency vehicles would have no access to this area from 7:30 p.m. through <br />the night. <br /> <br />Ms. Hunt questioned why La Petite Academy was able to establish business hours which are <br />not in compliance with the existing ordinance. <br /> <br />Kate Stephens, 2793 Longspur Way, noted that the daycare issue is not the main focus of the <br />neighbors. The gate is their primary focus. Her belief was that the gate would eliminate all <br />people in this area from 7:30 p.m. to 6:30 a.m. She feels the operation of the daycare <br />facility is detrimental to her life because of the noise. <br /> <br />Erin Busby, on-site director of La Petite Academy, commented that the neighbors' concerns <br />regarding the gate and daycare were big issues to La Petite Academy. It will be an <br />economic hardship for both parents and La Petite Academy if not allowed to operate at <br />6:00 a.m. She understands the gate is to be closed from 7:30 p.m. to 6:30 a.m., but that <br />should not affect their hours of operation. She clarified that the children are not outside at <br />6:30 a.m. During the summer they are out as early as 8:00 a.m., and during the rest of the <br />year, they are out at 9:00 a.m. Ms. Busby also feels the noise would be louder and last <br />longer with children walking through the parking lot as opposed to the noise generated by <br />driving. She noted there has been more vandalism since the gate has been installed. <br />Further, La Petite Academy is the only building in the center which would not have access to <br />it by fire vehicles. The rescue of handicapped children is a major concern to her. Ms. <br />Busby is worried because there is no lighting in the parking area, which affects the safety of <br />the children and employees. <br /> <br />The cleaning crew has been coming in earlier, but this can be changed. In response to an <br />earlier comment that the daycare is not a part of the neighborhood, Ms. Busby noted the <br />many activities and community events La Petite Academy participates in. <br /> <br />Planning Commission Minutes <br /> <br />Page 10 <br /> <br />November 8, 1995 <br />
