to conditional use permits for this PUD. She noted the children of La Petite Academy are
playing outside before 9:00 a.m. Ms. Stephens does not believe La Petite Academy seeks to
be part of the neighborhood. She would prefer to have office use only for Building 5.

Commissioner Hovingh asked Ms. Stephens to write letters of appreciation for Messrs. Otto
and Iserson to the City Manager. He also noted that office use may not be totally
satisfactory because office personnel may stay later than retail uses.

In response to Commissioner McGuirk, Ms. Stephens would like the Commission to direct
staff to continue working with the neighbors, resolve office use only for Building 5, and
conditional uses for La Petite Academy.

Nancy Pozzebon, 2808 Longspur Way, is an original owner on the street. She noted that the
recent negotiations were the first opportunity to meet and work with Planning staff and the
property manager. She noted the property manager's success to stop the sweepers, stop the
bottle breaking from Popi Lounge, and removal of the night lights. Ms. Pozzebon would
also like to see Building 5 be office use only. She understood this to be the original intent of
the shopping center. She does not mind the retail stores occupation until they leave. She
also agrees to the addition of the lattice panels, and noted the fence was originally put up by
the shopping center. She wants the negotiations to continue between the neighbors and the
shopping center managers.

Donna Tavares, 2416 Pasatiempo Street, Livermore, has two children who attend La Petite
Academy. She needs the 6:00 a.m. daycare opening due to her work schedule. She objects
to the gate closing and having to walk her children to the daycare entrance.

Gina Hisel, 1344 Greenwood Road, has children attending La Petite Academy, and arrives
between 6:00 a.m. and 6:45 a.m. due to her work schedule. She has not noticed any noisy
situations, and thinks it would be noisier to have children walk in. She feels the issue is
what is in the best interest of the children and their health and safety. She understands the
residents concerns, but does not agree to closing the parking lot for an additional 30 minutes
in the morning.

Kathryn Marcum, 5585 Springhouse Dr., #23, has children attending La Petite Academy.
She believes this is the only daycare facility open at 6:00 a.m., and feels their responsibility
should be to the children and not the neighborhood. She also concurs with the gate opening
at 6:00 a.m. Keeping the gate closed will create an unsafe environment.

Lisa Hunt, 2790 Longspur Way, stated that she is sorry to have upset parents of La Petite
Academy. The daycare is only one part of the center's problems. The neighbors' intent was
not to restrict or close down the daycare. Ms. Hunt asked that service and delivery trucks
not be allowed in the area until 8:00 a.m. She supports office use only for Bldg 5. Ms.
Hunt requested that the sentence on page 9 of the staff report, "However, given staff's

Planning Commission Minutes

Page 9

November 8, 1995
