<br />Mr. Iserson described the operations of the business and the brewing operations. The <br />applicant stated that he would use an approximately 218 gallon brew kettle and four <br />fermenting and four finishing/serving tanks. Brewing operations would occur from <br />6:30 a.m. to 9:00 a.m. and venting of steam would also occur during the same period of <br />time, once or twice a week. <br /> <br />Mr. Iserson described the applicant's proposed food service activities and schedule. There <br />will be a maximum of six employees, seating for 100 customers, and use of the existing <br />outside patio is anticipated. The applicant stated there will be no loud music, no pool tables, <br />no video games. The applicant seeks to run a respectable downtown bar/brew pub. <br /> <br />There are a few homes in the immediate area on Ray Street. Mr. Spiliotopoulos is asking <br />that a fence be installed to shield his mother's residence from possible nuisances of the brew <br />pub. Staff made an addition of a fence to be a condition of the use permit; however, Mr. <br />Spiliotopoulos advised he does not desire the fence to continue along the eastern side of the <br />driveway of the 357 Ray Street residence. Therefore, this part of the condition may be <br />deleted. <br /> <br />Regarding the odors coming from the brewing process, after staff's research with other <br />communities, staff feels these odors are rather benign. Filters can be installed to more <br />completely eliminate the odors, however, it is staff's position to not require the filters until it <br />is determined that the odors are offensive to the neighbors. Staff received a letter from the <br />neighboring building tenants expressing their concern about the potential nuisance of the <br />odors. The Commission may want to require the installation of the filters at this time to <br />accommodate these concerns. <br /> <br />The downtown Central Commercial zoning does not require additional parking for a change <br />in business use. There is an existing parking lot behind the building with 35 parking spaces. <br />Staff feels the availability of on-street parking as well as the parking lot will provide <br />sufficient parking for this use. <br /> <br />Mr. Iserson also noted that the applicant is required to get the approval from the Alcohol <br />Beverage Control to serve alcohol on the outdoor patio. If approval is withheld, Mr. Billings <br />may only serve food on the deck. <br /> <br />Mr. Iserson again noted that the second sentence of Condition 18 should be deleted. <br /> <br />Based on the above discussion, staff recommends approval of Case UP-95-54, subject to the <br />attached conditions of approval in Exhibit "B." <br /> <br />Commissioner Barker inquired if the Air Quality Control Board would have jurisdiction over <br />the venting odors of this operation.
