PUBLIC HEARING WAS OPENED

Judy Morris, 1174 Blanc Court, represented her application for a non-exempt home
occupation permit. She noted that there is enough room for two cars to park in her driveway
and only one client per session will be allowed. The applicant also advised the conditions of
approval were acceptable. However, Ms. Morris noted that at the time of application, she
quickly wrote down what her business practices were. She now believes she would also like
to incorporate an evening session from 7:30 to 9:00 pm.

Commissioner Hovingh was not comfortable allowing a nightly session three nights per
week. He asked that it be conditioned to only one night-time session. Ms. Morris thought
that it would be difficult to work within that parameter because her students are working
adults who need the flexibility of evening hours.

PUBLIC HEARING WAS CLOSED

Commissioner Hovingh motioned, seconded by Commissioner Barker, making the
conditional use permit findings and approving Case UP-95-52, subject to the conditions
listed in Exhibit "B," with the following modification:

Condition 2: The hours of operation shall be Tuesday through Thursday 10:00
am through 9:00 pm.

ROLL CALL VOTE
AYES: Commissioners Barker, Hovingh, McGuirk, Wright and Chairman Lutz
NOES: None
ABSENT: None
ABSTAIN: None

Resolution No. PC 95-75 was entered approving Case UP-95-52, as motioned.

c. up-95-54. Matt Billine:s
Application for a conditional use permit to operate a brew pub with food service in an
existing building (The Cheese Factory) located at 830 Main Street. Zoning for the
property is Central Commercial (C-C) District.

Mr. Iserson presented the staff report for a conditional use permit to establish a brew pub
with food service in a portion of the existing building at 830 Main Street (formerly the
Cheese Factory). The beermaking operations of this business will be contingent upon the
effective date of the modified ordinance which the City Council probably will adopt at their
October 17, 1995, meeting, as well as subject to a 30-day effective period. However,
sales/service of beer produced elsewhere would be permitted as a "bar" under the existing
code as soon as the 15-day appeal period for this use permit has elapsed.

Planning Commission Minutes

Page 3

October 11, 1995
