<br />f. RZ-95-05. Citv of Pleasanton <br />Application to amend the Pleasanton Municipal Code to address brew pubs, <br />microbreweries, and other beermaking establishments. <br /> <br />Mr. Swift presented the staff report on the City's application to amend the Municipal Code <br />to address brew pubs, microbreweries, and other beerrnaking establishments. There have <br />been many inquiries of staff to establish microbreweries and/or brew pubs within the City. <br />Staff has created three new categories within the Code for where brew pubs, microbreweries, <br />and large breweries would be located. Staff has also revised the definition of a bar. Mr. <br />Swift noted the small microbreweries are to be located in the Service Commercial, Central <br />Commercial, and Stoneridge Mall districts. Brew pubs are conditionally allowed uses in the <br />same zoning districts that allow bars. <br /> <br />Commissioner Hovingh inquired if the City has any constraints of locating bars near <br />churches. Mr. Swift stated there were no such constraints, however, since they are <br />conditionally allowed uses, a case-by-case review of potential neighbors would be done. <br /> <br />Regarding the odors of the beer brewing, Commissioner Hovingh inquired if residents have <br />any recourse. Mr. Swift advised the residents would have recourse only if the odor exceeded <br />the industrial/commercial code ordinances. <br /> <br />In response to Commissioner Dove, Mr. Swift advised that all building code, health code, <br />and fire code requirements would have to be satisfied. <br /> <br />Commissioner Wright inquired if this use would be an allowed use in enclosed malls (Le., <br />Stoneridge). Mr. Swift noted that it would be an allowed use, although he was unsure if <br />such a use would be allowed by the Mall and whether it would be a profitable venture. <br /> <br />Referring to the 10,000 sq. ft. size limit on microbreweries, Chairman Lutz questioned if the <br />size was arbitrarily set by staff. Mr. Swift advised the size is based on what staff feels is the <br />largest lease space in a shopping center. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Mark Garetz, HopTech, 3015 Hopyard Road, #E, stated he came to answer any technical <br />questions of the Commissioners. He feels staff did an excellent job in amending the Code. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Hovingh advised that he has some concern for the neighborhoods being <br />impacted by noise and/or odors by these types of production plants. Mr. Swift stated that if <br />there is a concern of the Planning Commission, they could add a restriction on noise and <br />odors which would be subject to review.
