Wells <br />Application for a home occupation use permit to conduct group, semi-private, and <br />private tutoring sessions, Monday through Friday, 2:00 p.m. until 8 p.m., in the <br />residence located at 1021 Crellin Road. Zoning for the property is R-1-6,500 District. <br /> <br />Continued to August 23, 1995. <br /> <br />b. UP-95-43. Garv Hamlin (Garlex Pizza) <br />Application for a conditional use permit to allow the operation of a 1,940 square foot <br />take-out restaurant with delivery from the Valley Plaza Shopping Center located at 4301 <br />#A Valley Avenue. Zoning for the property is PUD (Planned Unit Development) - C <br />(Commercial) District. <br /> <br />Mr. Iserson presented the staff report for the application for a conditional use permit to <br />operate aI, 940 square foot take-out restaurant with delivery from the Valley Plaza Shopping <br />Center located at 4301 #A Valley Avenue. This business is currently operating at the <br />Amador Center. <br /> <br />Mr. Iserson noted that there would be no restaurant seating in this facility, and clarified that <br />there are Sunday hours, although the staff report noted otherwise. The employees use their <br />own vehicles for delivery, thereby eliminating the fleet of Garlex delivery trucks. There is <br />adequate parking space for this use. The applicant would like to use the west side of the <br />building for the employee parking. This area is red striped for no parking. The applicant <br />and the Fire Department must work together in order for the applicant to use the currently <br />red zoned area for delivery vehicle parking. Condition 7 must be revised or deleted because <br />parking is prohibited on the north of the building. Staff feels the use is appropriate and <br />recommends approval of the use permit subject to the conditions of approval in Exhibit B. <br /> <br />Commissioner Wright noted that he had been at the site and feels there is sufficient space for <br />a fire truck to pass through the area with the red curbing eliminated. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Gary Hamlin, 261 La Pera Circle, Danville, represented the application and noted his <br />agreement with the conditions of approval. He spoke with Bill Halverson of the Fire <br />Department and was advised that the red curb area is not a fire lane -- it was been painted <br />that way as a loading zone for Perry Liquors.
