<br />Commissioner Barker asked about the coordination of the street paving project. Mr. Higdon <br />stated the paving project is in the CIP and the two-year plan. Coordination of the paving <br />project depends on when the St. John's Place construction begins. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Scott Stringer, 675 Hartz Avenue, Danville, noted agreement with the staff report and the <br />conditions of approval of the Tentative Map 6728. <br /> <br />In response to Commissioner Hovingh's reference to Condition 6 (removal of graffiti), Mr. <br />Stringer feels there would be no objection to a time limit for removal of graffiti, however, he <br />does feel the 24 hour time frame is too restrictive. Mr. Higdon advised an open contract <br />takes about 2-3 days for turn-around. Mr. Swift advised that the City has a response of <br />about 24 hours, however, a week seems more reasonable for a Homeowners Association. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Wright noted that the creek trail does not have a high visibility to foster more <br />graffiti. Commissioner Hovingh countered that with low visibility, there's more accessibility <br />to do tagging. <br /> <br />Discussion ensued about how the graffiti would be reported and enforcement of the seven <br />day time period. Mr. Swift advised that the homeowners and/or public would advise the <br />City, the City would then advise the Homeowners Association, and they would have seven <br />days to remove the graffiti. <br /> <br />Commissioner Wright motioned, seconded by Commissioner McGuirk, making the <br />tentative map findings and approving the vesting map application subject to the <br />conditions of approval listed in Exhibit B, with the following modification: <br /> <br />Condition 6: The CCR's for the project shall require that the homeowners <br />association be responsible specifically for cleaning of graffiti along the trail within seven <br />days of notification. <br /> <br />ROLL CALL VOTE <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Barker, Hovingh, McGuirk, Wright and Chairman Lutz <br />None <br />None <br />None <br /> <br />Resolution No. PC-95-41 was entered approving Vesting Tentative Map 6728, St. John's <br />Place, as motioned. <br /> <br />Planning Commission Minutes <br /> <br />Page 12 <br /> <br />June 28, 1995 <br />
