Mr. and Mrs. Frank Vranek <br />Application for a conditional use permit and design review approval to constmct an <br />approximately 3,477 square foot building to be utilized for additional classroom area, <br />and a variance for a fence in the front yard setback, at the Early Years Children's <br />Center located at 1251 Hopyard Road. Zoning for the property is R-1-6,500 District. <br />The Planning Commission will also consider the Negative Declaration prepared for the <br />project. <br /> <br />Mr. Swift presented the staff report for a use permit and design review approval to construct <br />an approximately 3,477 sq. ft. building to be utilized as additional classroom area for the <br />Early Years Children's Center at 1251 Hopyard Rd. <br /> <br />The additional space will allow for an increased enrollment from 48 to 100 children. <br />Additional space is also required for outdoor open space/play area. The front yard will be <br />turned into the outdoor play area. A variance on the fencing is required because daycare <br />facilities must have at least 48 inch fences where only 30 inch fences are allowed in R-l- <br />6500 wning. <br /> <br />This facility has been operating quite successfully for a number of years. Parking is located <br />to the rear of the site through an easement granted by the neighboring church. The new <br />building will be located to the rear of the property and is designed to match the architecture <br />of the existing building. Staff noted the strong support in the General Plan for daycare <br />facilities. <br /> <br />Regarding the front yard fence variance, staff feels this particular location is an atypical <br />residential setting. Therefore, staff believes the state-required four foot minimum fence <br />height is not so high as to unduly block the view of the front of the building. The front <br />fence will be black vinyl clad chain link fencing, and a five foot planter area is located <br />between the sidewalk and the fence, which will also help screen the fencing. <br /> <br />Mr. Swift advised that staff is recommending approval of the use permit, the design review <br />and the variance. A Negative Declaration also needs to be approved. Further, staff feels <br />there is a de minimus impact on the site because of its urbanization. <br /> <br />Commissioner McGuirk inquired why this lot was zone R-1-6500. Mr. Swift advised the <br />entire area was so zoned except for a few high density lots.
