<br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Wright had a concern about noise and agrees to the concept of the three <br />month sunset clause. He is also concerned about the precedence-setting aspect. Because <br />non-exempt permits are decided on a case-by-case basis, Commissioner Wright feels the <br />precedence-setting aspect is mitigated. He supports this application. Commissioner Wright <br />also suggested limiting the number of hours of operation to 4 pm - 8 pm, Monday-Friday; <br />8 am - 5 pm, Saturday; and no Sunday hours. <br /> <br />Commissioner Hovingh phrased his request for a condition to be "This application will <br />expire in three months. If there are no neighbor complaints, the applicant may appear before <br />the Commission to renew his permit." Commissioner Wright inquired of staff how they <br />would handle the sunset clause. Mr. Plucker advised Condition 9 could be used instead of <br />adding another condition; if there are no neighbor complaints, the permit could be continued <br />administratively. If there are complaints and/or problems, the Planning Director would refer <br />this application back to the Planning Commission. In response to Commissioner Hovingh, <br />Mr. Plucker stated Condition 9 could be modified to include that the neighbors would be <br />noticed at the end of the six month time. <br /> <br />Commissioner McGuirk inquired as to the procedure if a neighbor complained to staff.
