<br />6.. PUBLIC HEARINGS <br /> <br />L UP-95-21. David Conlde <br />Application for a conditional use permit to allow a non-exempt home occupation of <br />small engine repair business to operate at 6789 Rancho Court. Zoning for the property <br />is R-1-6,500 District. <br /> <br />Greg Plucker presented the staff report for an application for a non-exempt home occupation <br />permit to allow the establishment of a small engine service and repair business at 6789 <br />Rancho Court. Staff feels that this application fails to meet two of the criteria (noise and <br />odors) for a non-exempt home occupation permit in Section 18.104.30 of the Municipal <br />Code. Furthermore, staff feels if the Commission approves this application, it will lead to <br />setting a precedence for future non-exempt home occupations. Staff recommends denial of <br />this application. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />David Conkle, 6789 Rancho Court, represented his non-exempt home occupation permit <br />application. Mr. Conkle had talked with his neighbors and collected neighbor signatures in <br />support of his business. Mr. Conkle stated he had read and concurred with all the conditions <br />of approval. <br /> <br />In response to Commissioner McGuirk, Mr. Conkle stated he does not at this time use his <br />garage for parking vehicles, and he would conduct his business within the garage. <br />Furthermore, the neighbors closest to him who could potentially be impacted by the noise <br />and fumes have signed his petition of support. Because this business is not Mr. Conkle's <br />primary occupation, the hours of operation would be limited. The Commission further <br />clarified which of his neighbors had signed his petition of support. For the record, the <br />residents on Singletree Way and Melody Court signed his petition, as well as 6786, 6762, <br />6750 Rancho Court. <br /> <br />Commissioner McGuirk inquired if the applicant had been doing this type of repair <br />previously. Mr. Conkle stated he has only taken a course in engine repair and has not yet <br />started doing any repair work. <br /> <br />Commissioner Hovingh inquired if he would agree to a three month time period to test if any <br />neighbors are negatively impacted by his business. The applicant agreed to this request. <br /> <br />Commissioner Dove inquired of staff if there was some type of equipment to monitor the <br />carbon monoxide. Mr. Plucker believes that having the garage side and main doors open <br />will provide adequate ventilation. Commissioner Dove requested the applicant to not lower <br />the garage door in order to mitigate the noise thereby potentially increasing the level of <br />carbon monoxide in the garage. <br /> <br />Planning Commia.ion Minutes <br /> <br />Page 2 <br /> <br />June 14, 1995 <br /> <br />. <br />
