<br />Mr. Higdon noted a few changes to the Code modifications as listed: <br /> <br />17.16.006 - No.2... measured four *we and one-half feet above ground level; <br /> <br />17.16.010 - B. ... penalties as provided in Section 17.16.110 17.16.120 of this <br />chapter. <br /> <br />Commissioner Hovingh commented that a very large oak tree was removed in the <br />development of Laguna Oaks. He inquired if that would have cost the developer several <br />thousand dollars to remove. Mr. Higdon advised that if the tree was approved to be <br />removed in the development plan, there would be no punitive damages. If the tree was <br />removed without prior approval, a fine would be levied. This also applies to all approved <br />PUDs where no building permits have been issued. <br /> <br />After discussion of who would be able to prune trees within Pleasanton, Mr. Beougher <br />advised that an unlicensed individual may prune trees, however, it would be another matter <br />whether it was done correctly. Mr. Beougher also advised of a correction within the Code to <br />Section 17.16.100, adding to the last sentence "...shall carry public liability and property <br />damage insurance as determined by the City Attorney." Mr. Higdon advised that anyone <br />doing this type of business in Pleasanton must have a City Business License, where upon <br />they would receive a copy of the ordinance and a guide to pruning trees. Mr. Beougher <br />stated that this ordinance is aimed at the unlicensed, handyman-type businesses who do not <br />know the proper pruning procedures. <br /> <br />In response to Commissioner Hovingh inquiring if the City could generate a list of approved <br />contractors, Mr. Beougher noted that providing a list of names is acceptable because it does <br />not constitute an endorsement of anyone individual. <br /> <br />General discussion ensued regarding insurance requirements and Section 17.16.100. <br />Commissioner Barker feels this section is too strict. Mr. Beougher advised the section was <br />written in response to previous abuses. <br /> <br />Commissioner Dove inquired how the general public would know if they have a Heritage <br />tree on their property. Chairman Wright inquired if this ordinance would be noticed to the <br />tree pruning businesses.
