<br />Mr. Swift presented the staff report regarding an appeal of the Zoning Administrator's <br />approval to establish a large family clay care home at 3444 Windsor Court. The applicants <br />currently operate a small day care with six or fewer children which does not require a use <br />permit. They are seeking to expand to allow up to 12 children. Staff has found that large <br />day care homes work well in Pleasanton residential neighborhoods. There is some concern <br />in the neighborhood that the large family day care home will not blend into the <br />neighborhood. Staff notes that under the State Regulatory Scheme, this use is considered a <br />residential use, and the City's review can only look at areas regarding over-concentration, <br />traffic congestion, parking, and other site-specific issues. This site is very similar to other <br />areas where daycares have operated satisfactorily and staff is recommending approval of this <br />application subject to numerous conditions, one of which imposes a six month review. <br /> <br />Commissioner McGuirk clarified that "over-concentration" refers to the number of daycares <br />in anyone neighborhood. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Candy and Jeffrey Phillips, 3444 Windsor Court, spoke on behalf of their application. Ms. <br />Phillips stated she has lived on the court for 25 years and 18 years ago started a daycare <br />which last about four years. She did not know she needed a license at that time. <br /> <br />About ten months ago, the Phillips decided to reopen a daycare. They researched other day <br />care facilities, available toys on the market, earthquake-proofed their home, and installed <br />smoke detectors in every room as well as a carbon monoxide detector. They have exceeded <br />the state requirements for the number of fire extinguishers and smoke detectors. The <br />applicants have taken AIDS tests. The have purchased all new equipment, etc. <br /> <br />They have asked all parents to use their driveway for parking, therefore, almost no one ever <br />proceeds down to the cul-de-sac. The Phillips asked their nephew's friends to visit during <br />the evening only. Ms. Phillips stated that her love for children is her reason for operating a <br />day care. She proposes to have only younger children in her day care, approximately birth <br />to three years of age. <br /> <br />Mr. Phillips advised they have had the day care in operation for six months and have had no <br />complaints. Ms. Phillips distributed pictures for the Commissioners to view their facilities. <br /> <br />Ms. Phillips stated she has read and agrees with the conditions and staff report. She noted <br />all conditions have been met except for moving a piano, which will be done within the week. <br /> <br />In response to Commissioner Hovingh, Ms. Phillips advised that they do not smoke and do <br />not allow anyone to smoke in their home. <br /> <br />Commissioner Barker clarified with the applicant that she can have only four children under <br />the age of two at anyone time and Condition 19 restricts the applicants to children up to <br /> <br />Planning Commission Minules <br /> <br />Page 3 <br /> <br />February 8, 1995 <br />
