City Engineer's decision will be upheld. Mr. Higdon advised that the center lines of the
street do not match and staff will investigate the allowable offsets to allow for a safe street.

PUBLIC HEARING WAS RE-OPENED

Mr. Bates stated that Condition 88 was acceptable.

PUBLIC HEARING WAS CLOSED

Condition 91: Chairman Wright would like the applicant to make a good faith effort while
paving the development to also repair/patch the existing streets to an acceptable level. Mr.
Higdon feels that overlaying of asphalt will be an undue burden on the developer considering
the extensive work that needs to be done on these streets.

Condition 98: Chairman Wright can't agree to requiring the developer to underground the
power lines under the arroyo. Incorporating it into the bridge crossing may not be feasible
because of the high voltage involved. Discussion ensued regarding where the power lines
should be located in the development (through Lot 11 and also down Pleasanton Avenue
through the mini park).

PUBLIC HEARING WAS RE-OPENED

Mr. Elsnab stated that the power lines are quite large and service a wide area in the
neighborhood.

Mr. Bates indicated on the project map the length of the wires presently and advised that the
proposed locations are those suggested by PG&E.

PUBLIC HEARING WAS CLOSED

A motion was made by Commi~sioner Hovingh, seconded by Commi~ioner McGuirk,
adopting the Negative Declaration but with no fmdings of De Minimis impact for
purposes of the Department of Fish and Game fee structure.

ROLL CALL VOTE

AYES:
NOES:
ABSENT:
ABSTAIN:

Commissioners Hovingh, Lutz, McGuirk, Barker, and Chairman Wright
None
None
None

Resolution No. PC-9S-04 was entered adopting the Negative Declaration with no De
Minimi~ fmdings, as motioned.

Planning Commission Minules

Page g

January 25, 1995
