<br />Chairman Wright would like the developer to contact the parties involved in approving the <br />EVA. The existing neighborhood has functioned without an EVA, and he feels it is too <br />stringent to restrict occupancy without an EVA constructed. Chairman Wright suggested that <br />if the bond is in place, and negotiations are proceeding, that 25 % occupancy should be <br />allowed before EVA approvals are granted. Mr. Beougher advised to leave it as it is; if a <br />problem occurs, the developer will be able to provide a history of his negotiations which <br />could be addressed at a later time. <br /> <br />Commissioner McGuirk clarified that the fence required in Condition 33 was to prevent <br />heavy equipment from getting too close to the banks of the arroyo. A snow fence would be <br />an acceptable fencing. <br /> <br />Commissioner Barker inquired if the application could be conditioned to require the <br />developer to do an asphalt overlay on Pleasanton Avenue if the City has previously not done <br />the street reconstruction. Chairman Wright could agree to the developer repaving the street <br />with some reimbursement made by the City, but he cannot agree with the developer having <br />to repave the street as a condition of approval. Mr. Swift noted that staff is hoping to be <br />able to dovetail the two projects. Commissioner Barker feels it is reasonable to require the <br />developer to provide an asphalt overlay to the streets. Commissioner McGuirk feels the <br />developer should do something because of the construction activity, such as fill holes and <br />patch, etc., to bring the street back to its pre-project condition. <br /> <br />Regarding Condition 29, Chairman Wright feels the liabilities are understood, either the City <br />or the Homeowners Association will be liable for occurrences. <br /> <br />Regarding Condition 32, the geotechnic consultant will be required during specific <br />engineering tasks (mass grading and excavation). <br /> <br />Condition 33 refers to a temporary fence, such as a snow fence. <br /> <br />Condition 35 was addressed by the applicant by stating that the approvals are ready to be <br />signed off. <br /> <br />Condition 40: Commissioner Hovingh feels the hours from 8 a.m. to 5 p.m. are not <br />unreasonable construction hours for a neighborhood. Chairman Wright would rather have a <br />7 a.m. start time. Mr. Higdon advised that the biggest complaint construction inspectors <br />have in the summer is the 7 a.m. construction start time. With the start time being at 8 <br />a.m., Chairman Wright would also like to include the 10 a.m. to 5 p.m. Saturday work day. <br /> <br />Condition 46 is agreed to by Mr. Bates. <br /> <br />Condition 88: Chairman Wright concurs with aligning Pleasanton Avenue along the street <br />center lines and keeping the street balanced on each site.
