The proposed development plan is compatible with previously developed <br />properties located in the vicinity of the plan. <br /> <br />The subject property is a stand-alone site surrounded by a variety of <br />predominantly service commercial uses. The limited sales of beer and wine from <br />the convenience market is compatible with the character of surrounding uses. <br />Therefore, this finding can be made. <br /> <br />3. Adequate public safety measures have been incorporated into the proposed <br />development plan modifications. <br /> <br />California State law places restrictions on the concurrent sale of fuel and alcohol <br />which are referenced in the conditions of approval and which would be followed <br />by the facility's owners and operators. Therefore, this finding can be made. <br /> <br />WHEREAS, the Planning Commission made the following findings for the conditional use <br />permit: <br /> <br />1. The location ofthe proposed conditional use is in accordance with the <br />objectives ofthe zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The Stanley Business Park PUD development plan references the permitted and <br />conditionally allowed uses of the CS (Service Commercial) District which <br />includes self-service stations with convenience markets and drive-through <br />carwashes as conditional uses. The proposed self-service gasoline station, <br />convenience market, and drive-through carwash would be operated in a manner <br />making it compatible with the existing and future nearby developments. <br />Therefore, this finding can be made. <br /> <br />2. The proposed location of the conditional use and the conditions under <br />which the conditional uses would be operated or maintained will not be <br />detrimental to the public health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />Vehicular access is provided from Bernal Avenue and Utah Avenue. Adequate <br />parking is provided for employees and customers. Therefore, this finding can be <br />made. <br /> <br />3. The proposed conditional use will comply with each ofthe applicable <br />provisions of the Pleasanton Municipal Code. <br /> <br />The proposed conditional use is required to comply with all applicable sections of <br />the Pleasanton Municipal Code. By complying with the conditions of approval, <br />the proposed facility would meet the criteria for receiving a conditional use permit <br /> <br />- <br />
