<br />PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2004-57 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF <br />F AIRLAND INVESTMENT, INC. FOR PUD MAJOR MODIFICA nON AND <br />CONDITIONAL USE PERMIT, AS FILED UNDER CASE PCUP-86/PUD-81-25-6M. <br /> <br />WHEREAS, Fairland Investment, Inc. has applied for conditional use permit approval of a <br />self-service gasoline station on an approximately 1.25-acre site located at <br />3121 Bernal Avenue and 3581 Utah Street consisting of eight fuel dispensers, a <br />drive-through carwash, a 3,600-square-foot convenience market, and a <br />modification to the Stanley Business Park PUD development plan to allow <br />alcoholic beverage sales from the convenience market; and <br /> <br />WHEREAS, zoning for the property is PUD-C (Planned Unit Development - Commercial) <br />District; and <br /> <br />WHEREAS, at its duly noticed public hearings of September 8, 2004 and September 22, 2004, <br />the Planning Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br /> <br />WHEREAS, at its meeting of September 22, 2004, the Planning Commission reviewed and <br />recommended approval of the Initial Study and Negative Declaration prepared for <br />this project, pursuant to Resolution No. PC-2004-56; and <br /> <br />WHEREAS, the Planning Commission determined that the proposed project is appropriate for <br />the site; and <br /> <br />WHEREAS, the Planning Commission made a finding that the project conforms to the <br />Pleasanton General Plan; and <br /> <br />WHEREAS, the Planning Commission made the following findings for the PUD development <br />plan modification: <br /> <br />1. The proposed development plan modifications are in the best interests of <br />the public health, safety, and general welfare. <br /> <br />The limited sales of beer and wine from the proposed convenience market has <br />been allowed in other service stations with convenience stores in Pleasanton with <br />no reported problems by the Pleasanton Police Department. Therefore, sales of <br />beer and wine would appear to be appropriate in this location as well. California <br />law places restrictions on the concurrent sale of fuel and alcohol which are <br />referenced in the conditions of approval and which would be followed by the <br />facility's owners and operators. Therefore, this finding can be made. <br /> <br />. <br />
