<br />Resolution No. PC-2004-57 <br />Page Three <br /> <br />and would, therefore, comply with the intent of the Pleasanton Municipal Code. <br />Therefore, this finding can be made. <br /> <br />WHEREAS, the Planning Commission finds that this project is consistent with the existing <br />General Plan, including General Plan traffic policies, because given this use is not <br />the kind of "major development" that triggers a requirement to mitigate all <br />intersections that have the potential to exceed Level-of-Service D. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Section 2. <br /> <br />Recommends approval of Case PCUP-86/PUD-81-25-6M, the application of <br />Fairland Investment, Inc. for conditional use permit approval of a self-service <br />gasoline station on an approximately 1.25-acre site located at 3121 Bernal Avenue <br />and 3581 Utah Street consisting of eight fuel dispensers, a drive-through carwash, <br />a 3,600-square-foot convenience market, and a modification to the Stanley <br />Business Park PUD development plan to allow alcoholic beverage sales from the <br />convenience market, subject to the conditions shown in Exhibit C for the <br />conditional use permit and in Exhibit D for the PUD modification, both of which <br />are attached hereto and made part of this case by reference. <br /> <br />This resolution shall become effective immediately upon its passage and <br />adoption. <br /> <br />THIS RESOLUTION ADOPTED BY THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON ON THE 22ND DAY OF SEPTEMBER 2004 BY THE FOLLOWING VOTE: <br /> <br />AYES: <br />NOES: <br />ABSTAIN: <br />ABSENT: <br />RECUSED: <br /> <br />Commissioners Arkin, Maas, and Roberts. <br />Commissioners Fox and Sullivan. <br />None. <br />Commissioner Kameny. <br />None. <br /> <br />ATTEST: <br /> <br />c;?t///J C4~A~ <br />a G.
