.- Commissioner Kameny moved to approve PDR-408 as conditioned in the staff <br />report, with the moditicatiou that the atom logo may use the fiber optic technology <br />for slow color shifts unless the Planning Director finds that it is blinking, fluttering, <br />flashing, or changing colors too quickly. <br />Commissioner Maas seconded the motion. <br />ROLL CALL VOTE: <br />AYES: Commissioners Arkin, Kameny, Maas, Roberts, and Sullivan. <br />NOES: None. <br />ABSTAIN: None. <br />RECUSED: None. <br />ABSENT: None. <br />Resolution No. PC-2004-60 was entered and adopted as motioned. <br />b. PCUP-127. Plush Beauty Bar <br />Application for conditional use permit approval to serve beer and wine to <br />customers at an existing beauty salon located at 4001 Santa Rita Road. Zoning <br />for the property is C-C (Central Commercial) District. <br />Ms. Kline summazized the staff report and described the use and operating hours. The <br />wine and beer would be consumed in a separate area of the salon, and all employees must <br />be trained in beer and wine sales. Soft, contemporazy music would be played by a disc <br />jockey. The Police Department did not express any concerns about this use. Staff <br />believes the beer and wine sales would be an incidental use to the existing salon and <br />would be compatible with other businesses in the shopping center. A condition was <br />added stating that the use permit may be revoked should any problems result from the <br />noise or the alcohol service. Staff has requested that food be served, and the applicant <br />agreed to that request. Staff has conducted several site visits and observed that there is <br />ample parking for this use. Staff received two comments during the notice period: one <br />call in support of this project, and another call from a resident concerned about patrons <br />driving with elevated blood alcohol levels. Staff believed that with the appropriate <br />training for Alcoholic Beverage Control (ABC), the salon staff should be able to prevent <br />those problems. Staff recommends approval of this application. <br />In response to an inquiry by Chairperson Roberts whether a resale license would be <br />required to sell bottles of wine to customers, Ms. Kline replied that the applicant would <br />acquire the necessazy ABC license for this; Ms. Mazcum would work in partnership with <br />the Wine Steward Downtown. <br />Commissioner Fox noted that a salon in San Ramon offers a complimentary glass of wine <br />versus selling the wine and inquired whether the applicant would be able to offer <br />complimentary wine in addition to selling it. She expressed concern about setting a <br />precedent in other businesses that provide services, such as automobile repair and tire <br />stores. <br />PLANNING COMMISSION MINUTES, October 13, 2004 Page 4 of 15 <br />
