REVISIONS AND OMISSIONS TO THE AGENDA <br />Mr. Iserson advised that Item 6.c. would be continued to the meeting of September 22, 2004. <br />5. MATTERS CONTINUED FOR DECISION <br />There were none. <br />6. PUBLIC HEARINGS AND OTHER MATTERS <br />a. PCUP-128 Patricia Cramer/World School of Massage and Holistic Healing Arts <br />Application for conditional use permit approval to operate a massage and holistic healing <br />arts school in an existing building located at 699 Peters Avenue. Zoning for the subject <br />site is C-C (Central Commercial) District and Downtown Revitalization District. <br />Mr. Iserson summarized the staff report. He described the background and scope of the project, <br />and staff did not believe there would be a significant impact on the area. A City-owned lot and <br />street parking would be sufficient for the use's parking needs. He noted that the last class ended <br />at 10:00 p.m., which may pose a noise issue to the residents across Peters Avenue; however, the <br />type of classes would not likely produce a noisy exit by the students. Staff added a condition <br />that if there was any loitering or noise in the parking lot that disturbed the neighbors, the use <br />permit could be reviewed and conditions of approval may be added, possibly including an earlier <br />closing time. Staff had not received any negative comments from anyone in the area and <br />believed that the use would be compatible with the Downtown district. Staff recommended <br />approval of this item. <br />In response to an inquiry by Commissioner Fox, Mr. Iserson described the complaint and Code <br />enforcement process, which began as an informal communication to the applicant and may <br />escalate to a more formal process if the applicant is not cooperative with staff. He noted that the <br />noise ordinance stood on its own and added that the noise standards in the use permit exceeded <br />those of the ordinance. <br />Ms. Nerland advised that when an applicant is approved for a conditional use permit or <br />PUD development plan, that would be considered to be a vested right. <br />THE PUBLIC HEARING WAS OPENED. <br />PLANNING COMMISSION MINUTES September 8, 2004 Page 2 of 14 <br />
