l-- Chairperson Roberts did not have a problem with the 50-foot buffer and was disturbed <br />that the antennas were not put on top of DSRSD, which is nowhere near the house. <br />Commissioner Sullivan moved as follows: <br />• to recommend to the City Council that if it decides to reduce the park buffer, <br />it first refer the ordinance to the Parks and Recreation Commission for input <br />and that park neighbors be notified; and <br />• to direct staff to examine the technical issues of collocation and increase <br />opportunities for collocation whenever possible. <br />Commissioner Maas seconded the motion. <br />Mr. Iserson clarified the Commission's desire that this item would go directly to City <br />Council, where a public hearing would be held. If at the end of the hearing, the Council <br />wants to reduce the buffer around the parks, the Planning Commission's recommendation <br />would be to continue the matter, send it to Parks and Recreation Commission, notice the <br />neighbors around the parks, and bring it before City Council again. <br />ROLL CALL VOTE <br />AYES: Commissioners Fox, Kameny, Maas, Roberts, and Sullivan. <br />NOES: None. <br />ABSTAIN: None. <br />ABSENT: Commissioner Arkin. <br />Resolution No. PC-2004-45 was entered and adopted as motioned. <br />e. Discussion and Action on a Letter to the Alameda County Plannine <br />Commission Reeardin~ the Granite Construction Comnany Asphalt Batch <br />Plant Located at the RMC Pacific Materials Pronerty, 1544 Stanley <br />Boulevard <br />Chairperson Roberts advised that she would recuse herself from this discussion. <br />Commissioner Kameny presided over this item. <br />Ms. Nerland presented the staff report, noting that this plant in question was located in <br />unincorporated Pleasanton and that the City did not have direct regulatory authority in <br />this matter. She noted that the City Council would consider this letter at its July 20, 2004 <br />meeting. She described the history of the use and the site. She noted that the Alameda <br />County Planning Commission had scheduled a hearing for July 27, 2004 to be held in <br />Pleasanton Council Chambers, but at Granite Construction Company's request, that <br />hearing has been rescheduled. <br />Ms. Nerland advised that the definition of "nuisance" in the Civil Code states that <br />"anything which is injurious to health, including, but not limited to, the illegal sale of <br />controlled substances, or is indecent or offensive to the senses, or an obstruction to the <br />free use of property, so as to interfere with the comfortable enjoyment of life or property, <br />PLANNING COMMISSION MINUTES July 14, 2004 Page 16 of 24 <br />
