She believed there were creative ways to express a justification for a <br />particulaz prohibition. <br />Commissioner Sullivan found it offensive that the Federal government can tell a local <br />government what it can and cannot base its decisions on. He believed that <br />notwithstanding the FCC's decisions, the City should be able to consider the safety <br />impacts of wireless antennas. <br />Commissioner Fox noted that the buffer zone in the sports park prohibited a proposed <br />antenna and that she did not see any location where an antenna could be located. <br />Ms. Hunter noted that they identified the commercial area at the corner of Valley Avenue <br />and Hopyard Road. Commissioner Fox that that the site fell within a childcare buffer. <br />THE PUBLIC HEARING WAS CLOSED. <br />In response to an inquiry by Commissioner Sullivan, Mr. Iserson stated that notices were <br />sent to people who expressed interest and that newspaper notices were printed as well. <br />Commissioner Fox noted that she was not interested in reducing the residential buffer or <br />the park buffer and that she was interested in having more flexibility to allow more <br />carriers to be located on a building. She would like to hear the Pazk and Recreation <br />Commission's opinion on this issue and would like the neighbors within 300 feet of parks <br />to be noticed. <br />Commissioner Sullivan agreed with Commissioner Fox's assessment and believed that <br />the neighbors should be notified of the Park and Recreation Commission's meeting. <br />Commissioner Fox moved to recommend approval to the City Council of PRZ-24 as <br />conditioned in the staff report, with the additional conditions that: <br />• the park and residential buffer zones would not be reduced; <br />• more antennas would be allowed on roofs; and <br />• the ordinance would be reviewed every three years. <br />Commissioner Sullivan seconded the motion. <br />ROLL CALL VOTE <br />AYES: Commissioners Fox, Maas, and Sullivan. <br />NOES: Commissioners Kameny and Roberts. <br />ABSTAIN: None. <br />ABSENT: Commissioner Arkin. <br />Resolution No. PC-2004-44 was entered and adopted as motioned. <br />Commissioner Kameny noted that he did not object to a 50-foot buffer and believed that <br />the ordinance should be reviewed when there were technical changes. <br />PLANNING COMMISSION MINUTES July 14, 2004 Page 15 of 24 <br />
