AB 2702 eliminated some of the more objectionable issues raised by last year's <br />bill but had some issues that staff felt were important to bring to the Planning <br />Commission's attention: <br />1. Clarifying the design review issue and the administrative hearings; <br />2. AB 2702 would prohibit a requirement that one of the units be <br />owner-occupied; <br />3. The bill would allow on-street parking to count towards the parking <br />requirement; and <br />4. The issue of school property being used for residential uses. <br />Ms. Nerland noted that staff was unsure what this bill was attempting to accomplish, and <br />it seemed that the school districts would still be able to circumvent the planning process. <br />Commissioner Sullivan noted that he agreed with the draft letter. <br />Commissioner Fox suggested that the Pleasanton Unified School District be copied on <br />the letter. <br />Commissioner Arkin moved to approve the language in the draft -etter as presented <br />and to authorize Chairperson Roberts to sign it. <br />Commissioner Sullivan seconded the motion. <br />ROLL CALL VOTE <br />AYES: Commissioners Arkin, Fox, Roberts, and Sullivan. <br />NOES: None. <br />ABSTAIN: None. <br />ABSENT: Commissioners Kameny and Maas. <br />The motion passed. <br />b. Agendizing Assembly Bills that may be of interest to the Commission. <br />Ms. Nerland noted that the City is a member of the League of California Cities, which <br />normally acts as a lobbyist on behalf of individual cities. Occasionally, an issue may <br />come up that would require attention by the City itself when time may be insufficient to <br />get three votes to agendize the issue. Staff suggested that a streamlined process be <br />initiated where staff may agendize the issue administratively. <br />Chairperson Roberts moved that staff place appropriate time-sensitive State bills on <br />the agenda for consideration by the Planning Commission. <br />Commissioner Arkin seconded the motion. <br />Commissioner Sullivan inquired whether an individual Commissioner may place a <br />time-critical Assembly Bill on the agenda. <br />PLANNING COMMISSION MINUTES Apri128, 2004 Page 13 of 16 <br />
