Commissioner Fox inquired whether outdoor displays at bookstores would be allowed. <br />Mr. Iserson noted that any store may apply for a decorative display where merchandise <br />may be displayed outside but was not considered to be a sidewalk sale. He noted that <br />was detailed in another section of the Code and would be limited to a small area. He <br />suggested that language could be borrowed for this item regarding the aesthetics of the <br />outdoor sales display. <br />Commissioner Kameny noted that he did not want to preclude appropriate business <br />activities and would agree with such a display if it did not cause a pedestrian, <br />attractiveness, fire, or access problem. <br />THE PUBLIC HEARING WAS OPENED. <br />James. Paxson, 4473 Willow Road, Suite 105, believed that staff's proposal was a good <br />process and supported the wording suggested by Mr. Iserson requiring an attractive <br />display. He noted that Hacienda used an extensive pre-screening process on all outdoor <br />events. He noted that they required the applicant to follow a checklist, which included a <br />list of materials that they must supply, including a site plan, noise analysis for outdoor <br />music, and hours of setup and breakdown. He noted that their applicant would not bring <br />the application to the City until they passed Hacienda's internal checklist. He noted that <br />the employees appreciated the company events very much. He noted that not many sales <br />events were held and added that it was important for them to meet the City's codes He <br />supported all of the modifications suggested by staff. <br />In response to an inquiry by Commissioner Arkin, Mr. Paxson confirmed that Wa1Mart <br />was part of Hacienda Business Park and that they reviewed their sidewalk sales. He <br />noted that WalMart submitted four event applications to the City per year and added that <br />this would be covered under the new Code. <br />Commissioner Arkin did not consider the WalMart displays to be attractive. Mr. Paxson <br />advised that he could work with them on their displays and added that they had been very <br />cooperative in the past. <br />THE PUBLIC HEARING WAS CLOSED. <br />Commissioner Arkin suggested that illustrations of desired and unattractive displays be <br />included as guidance to merchants. <br />Commissioner Kameny concurred with Commissioner Arkin's concern and stated that he <br />would not want to see industrial-style displays. <br />Commissioner Maas moved to recommend approval of PRZ-23, subject to the <br />conditions listed in Exhibit B of the staff report, with the modification that the <br />following language be added to Sections B.6. and C-5 of the proposed amendment: <br />"The Zoning Administrator has determined that the merchandise will be <br />attractively displayed in an organized manner." <br />PLANNING COMMISSION MINUTES Mazch 10, 2004 Page 7 of 10 <br />
