Hacienda Owners Association to propose a Code Amendment to add outdoor company <br />events to the Code. Staff believed that flexibility should be added to the process and <br />proposed that it be streamlined by not requiring temporary use permits. Staff believed <br />that the uses could be allowed as permitted uses, subject to meeting certain performance <br />standazds listed in the Code. He noted that it would be anover-the-counter process with <br />no application or fees required. He noted that the criteria would still be required to be <br />met and added that the internal process would be improved by working with the Police <br />and Fire Departments at the beginning of the process. Staff would then determine if the <br />parking, signage, decorations, and hours of operation would meet the criteria and then <br />approve the use over the counter. <br />Mr. Iserson noted that the restrictions in the Code would be maintained, limiting the <br />number of events per year, the number of consecutive days, and hours of operation. Staff <br />believed this change was consistent with the desired direction of the Zoning Ordinance, <br />whereby more routine types of conditional uses were becoming permitted uses subject to <br />performance standards. He noted this change would save time, money on the part of <br />development or business community, and paperwork while addressing the needs of the <br />public welfare. He noted that the Pleasanton Chamber of Commerce has supported this <br />proposal and recommended that the Planning Commission recommend approval of this <br />item to the City Council, subject to Exhibit A. <br />In response to an inquiry by Chairperson Roberts, Mr. Iserson replied that this item <br />addressed private property as a shopping center or an individual business. He noted that <br />_. street closures aze approved separately by City Council. <br />In response to an inquiry by Commissioner Fox, Mr. Iserson confirmed that the Noise <br />Ordinance would restrict music and setup/breakdown noise from commercial areas <br />impacting residential areas, which would include weekend mornings. <br />Commissioner Arkin recalled very large outdoor furniture sales that had been held in San <br />Fernando Valley and did not want to see similar sales take place in Pleasanton. <br />Mr. Iserson advised that sales of that kind had not been a problem in Pleasanton and that <br />staff has the authority and responsibility under the Ordinance to maintain adequate <br />parking for customers. He noted that business-owners typically moved a table or display <br />in front of their store. Staff felt comfortable proposing this item because past events had <br />not been excessive. He noted that the events would be limited to four times a year, three <br />consecutive days at a time. He noted that the requirement to maintain sufficient parking <br />would preclude using the entire parking lot for a sale. He added that criteria inay be <br />added to limit the area and address the type of display. <br />Commissioner Kameny understood Commissioner Arkin's concern. <br />Mr. Iserson advised that language could be added requiring that merchandise be <br />attractively displayed and that they relate to merchandise sold within the store. <br />PLANNING COMMISSION MINUTES March 10, 2004 Page 6 of 10 <br />
